Florida Expungement News
Since a petitioner that seeks to have his or her criminal arrest
record sealed or expunged is dependent upon the current law - not
the law in effect when he or she was arrested - it is important to
keep abreast of the potential changes that could be heading in our
direction. Here we have listed anything we have come across of
importance.
Legislative Updates
- Senate Bill 250, 2008
The Florida Legislature finally gets it right!
Some modifications to the expungement statute allowing for an
expungement when a defendant is acquitted of the charge he was
arrested for.
- (Dream Bill)
A law that expunges investigative
files.
Many people each year are investigated by law enforcement for
offenses that are never charged. Unfortunately, these
files become public records when the case is closed.
Currently there is no law requiring these files to be sealed or
expunged. The end effect is that embarrassing accusations
can remain a burden for those people accused of offenses that
fail to have enough
